Workplace Discrimination

Orlando, Florida
The Federal Civil Rights Act of 1964
prohibits employers from discriminating against employees
based on:
-
Gender
-
National Origin
-
Race or color
-
Religion
Additionally, The Florida Civil Rights
Act, modeled after the Federal Civil Rights Act of 1964, protects
employees against discrimination on the basis of race, color,
religion, gender, national origin, age and marital status.
There are additional federal laws such
as the Americans with Disabilities Act (ADA) which prohibits
disability discrimination and requires reasonable accommodation for
disabilities, and the Age Discrimination in Employment Act (ADEA)
which prohibits age discrimination in employment.
There are also additional federal laws
prohibiting discrimination, and for public sector employees there
are also constitutional protections that may be available.
These federal and Florida statutes were
designed to to ensure the fair treatment of employees by
their employer, making discrimination in the workplace
unlawful based upon these protected classifications.
However, there are many limitations and
restrictions upon who is covered by these laws and the legal proof
required to make a case under these laws. There are also
important and strict time deadlines that must be met in order to
satisfy the administrative prerequisites for these cases.
Employment discrimination cases
can be very difficult.
