Qui Tam,
False Claims, and Whistleblower Violations
Sigman & Sigman,
P.A., Attorneys at Law
Sigman & Sigman, P.A. has experience
representing individuals in 'Qui Tam' False Claims Act cases,
in which clients have information that their employer or any person
or company is committing
or has committed fraud against the United States government. On most occasions,
the fraud or false claims is/are related to the fraudulent billing
of government health care institutions or the Defense Department.
A person who files a qui tam case, claiming that a company is or has
been defrauding the government via false claims is called a "Relator".
If successful in the case, the Relator may receive a share of the
monies recovered by the government in the case. These cases
are very complex and require specialized handling, secrecy and
skill.
Laws protect from employment retaliation
those employees who 'blow the whistle' on fraud and false claims.
The Florida Whistleblower Acts (separate
laws for private sector and public sector employees) provide
protection against retaliation to
employees who 'blow the whistle' in relation to the employer's
violations
of law or regulation. An example is where
the employer tells their employees to dump hazardous waste
in the
public waterway, in violation of law, instead of legal disposal
methods. The employee needs
legal guidance on how to handle these
matters at work to protect their legal rights when they oppose
such employer practices.
